Move-In Feedback Giveaway – Terms & Conditions

Promotion Description

The WhatStorage Move-In Feedback Giveaway (“Giveaway”) begins on 8th June 2021 and is an ongoing monthly giveaway. Eligible participants (each, an “Entrant”) can enter by submitting a completed online Move-In Feedback entry form (“Entry”) which is sent sent via email to participants who have made a Storage Email Enquiry via the WhatStorage Ltd website.

Participation in the monthly Giveaway constitutes the Entrant’s full and unconditional agreement to and acceptance of these Official Rules below and by the decisions of WhatStorage Limited*, which are final and binding in all respects.

Eligibility

The Giveaway is open to all Entrants who have submitted a completed online Entry which is sent by WhatStorage sent via email to individuals who have made a Storage Email Enquiry via the WhatStorage Ltd website.

Employees, officers and directors of WhatStorage, or WhatStorage affiliates, subsidiaries, agents or advertising and promotion agencies (“Released Parties”), as well as the immediate family members (parents, children, siblings, spouses) or persons living in the same household (whether related or not) of the Released Parties are not eligible to participate in the Giveaway.

All federal, state and local laws and regulations apply. The giveaway is subject to all applicable laws and void where prohibited, taxed or restricted by law.

Winner Selection

One winner will be selected randomly from all Entrants who have entered during each given monthly Giveaway Period. Odds of winning will vary depending on the number of eligible Entries received.

Prize

The winner can choose to receive a £50 Amazon.com Gift Card in GBP. The Amazon.com Gift Card will be fulfilled via email to the email address of the winning entrant.

Winner Notification

Winner will be notified by email at the email address provided in the Entry Information on or about 48 hours after the random drawing. The potential winner must accept a prize by email within 48 hours of notification. Any winner notification not responded to or returned as undeliverable may result in prize forfeiture. If a prize winner cannot be contacted within 48 hours of email notification, or if a prize winner does not meet the eligibility requirements, that prize winner may be deemed ineligible and an alternate prize winner will be selected by WhatStorage based on the criteria described herein. In the event of a dispute regarding the identity of an individual who actually submitted a Giveaway entry, the entry will be deemed submitted by the authorized account holder of the email account. “Authorized account holder” is defined as the natural person who is assigned to an email account by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitting email address. Prizes are not exchangeable or transferable.

Publicity

By entering the Giveaway, each entrant grants WhatStorage permission to use the person’s opinions and statements for promotional purposes. Any use of the foregoing information may be in any manner or media now or hereafter known or existing, worldwide, in perpetuity and without compensation, notice or further consent, unless prohibited by law.

Terms and Conditions

The Entrant is responsible for all costs associated with the compilation and submission of their entries.
All Giveaway entries must be received during the Giveaway Period.
Incomplete entries, or those containing incorrect information, will be voided.
Proof of sending or submission will not be deemed to be proof of receipt by the Sponsor.
Entries must be submitted in English.
By participating in this Giveaway, the Entrant agrees to be bound by these Official Rules and the decisions of are final and binding in all matters relating to the Giveaway.

Limitation of Liability Release

By participating in this Giveaway, each entrant agrees that Sponsor and related organizations, their agents and employees (“Released Parties”) have no liability whatsoever for any injuries, losses, or damages of any kind which result from use of the Prize, or by participation in the Giveaway. No responsibility is assumed by WhatStorage Ltd for (a) incorrect or inaccurate entry information or late, unintelligible, illegible, damaged, mutilated, altered, incomplete, misdirected entries received through impermissible channels, all of which will be disqualified; (b) technical failures of any kind, including but not limited to the malfunctioning of any computer online systems, computer equipment, website, server provider, network, hardware or software; (c) the unavailability or inaccessibility of any website or service; (d) unauthorized intervention in any part of the entry process or the Giveaway including, without limitation, multiple entries by the same person through use of automatic registration or other similar programs; (e) typographical, electronic or human errors that may occur in the offer or administration of the Giveaway or the processing of entries; (f) any injury or damage to persons or property, including but not limited to entrant’s computer, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Giveaway, or from viewing, playing or downloading any material from Sponsor’s website; or (g) from the acceptance or use of the Prize.

WhatStorage reserves the right, without prior notice and at any time, to terminate or suspend the Giveaway in whole or in part, to extend the End Date or to modify the Giveaway or these Official Rules in any way, in its sole discretion. WhatStorage also reserves the right to void any entry if it believes such entry was submitted other than as required by these Official Rules or that the entry has been tampered with in any manner.

WhatStorage does not assume any responsibility for any schedule changes in the Giveaway timeline, including without limitation, scheduling conflicts, labour strikes, Acts of God, or other unforeseen events that disrupt the Giveaway schedule.

Internet Limitations of Liability

If for any reason, this Giveaway is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor that corrupts or affects the administration, security, fairness, integrity or proper conduct of the Giveaway, WhatStorage reserves the right, at its sole discretion, to terminate, modify or suspend the Giveaway in whole or in part, at any time, without notice and to select a winner, in Sponsor’s sole discretion, from all non-suspect eligible entries received as of the termination/suspension date. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, providers, computer equipment, software, failure or delay of any email or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof. Sponsor is not responsible for any damage to Entrant’s systems occasioned by participating in this Giveaway or by downloading any information necessary to participate in the Giveaway.

Disputes

By entering the Giveaway, Entrant agrees that (1) Any and all disputes, claims, and causes of action arising out of or connected with the Giveaway, or the prize awarded, shall be resolved individually, without resort to any form of class action; and (2) Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, and Entrant shall not seek or be entitled to any punitive, consequential, exemplary or other damages, including costs associated with entering the Giveaway or attorneys’ fees. Questions concerning the construction or interpretation of these Official Rules, or the rights and obligations of the Entrants and Sponsor in connection with the Giveaway, shall be determined by WhatStorage in its sole and absolute discretion.

ALL ISSUES AND QUESTIONS CONCERNING ISSUES THE CONSTRUCTION, VALIDITY INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES, OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR GIVEAWAY ENTITIES IN CONNECTION WITH THIS GIVEAWAY SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH UK LAW. ENTRANT RECOGNIZES THAT WHATSTORAGE IS DOMICILED IN ENGLAND AND THAT THE ORIGIN OF SERVICE PROVISION AND SUPPLY OF GOODS OCCURS IN ENGLAND THEN IT IS FAIR AND REASONABLE THAT THIS CONTRACT AND ITS TERMS ARE TO BE GOVERNED BY THE LAWS OF ENGLAND AND WALES. IT IS ALSO AGREED BY ENTRANT THAT ALL DISPUTES UNDER THIS AGREEMENT SHALL BE SUBJECT TO THE EXCLUSIVE JURISDICTION OF THE HIGH COURT OF ENGLAND, WITHOUT GIVING EFFECT TO ANY CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER COUNTRY’S LAWS. THE INVALIDITY OR UNENFORCEABILITY OF ANY PROVISION OF THESE RULES SHALL NOT AFFECT THE VALIDITY OR ENFORCEABILITY OF ANY OTHER PROVISION. IN THE EVENT THAT ANY PROVISION IS DETERMINED TO BE INVALID OR OTHERWISE UNENFORCEABLE OR ILLEGAL, THESE RULES SHALL OTHERWISE REMAIN IN EFFECT AND SHALL BE CONSTRUED IN ACCORDANCE WITH THEIR TERMS AS IF THE INVALID OR ILLEGAL PROVISION WERE NOT CONTAINED HEREIN.
